1. GENERAL
1.1. These are the terms and conditions of sale of Latitude 56 Degrees Limited (trading as 'LAT_56' or 'McLaren LAT_56'), whose registered office is at Unit 13 - District 10, 25 Greenmarket, Dundee, DD1 4QB, Scotland. Registered in Scotland with Company Number SC329614 and VAT Number 946792862 (′we′ or ′us′). For the purposes of these terms and conditions, 'LAT56' refers to Latitude 56 Degrees Ltd and any trading name of Latitude 56 Degrees Ltd.
These terms apply to the purchase of LAT56 products made using the lat56.com websites for the United Kingdom, Europe, USA, Canada and Rest of the World.
We recommend that you read this document carefully before placing your order. We reserve the right to make changes to these Sale Terms at any time. You will be subject to the Sale Terms in force at the time you place your order with us.
2. YOUR ORDER
2.1. Every order that you place on this website will be subject to acceptance in accordance with these Terms and Conditions.
The final details of your order will be set out on the "Check Out" page prior to proceeding to the "Payments" pages.
After the authorization of your debit card or credit card, we will send you an email confirming receipt of your order detailing the products you have ordered together with an order number. This email is not an order confirmation or order acceptance from LAT56. We reserve the right to cancel any order and/or refuse access to the website.
It is your responsibility to inform us immediately if there are any errors in your order.
3. PRODUCT GUARANTEE
3.1. We make high quality, durable products that are guaranteed to be free of defects in materials and workmanship for the first five years of ownership. If you find that your product is defective due to a problem with our manufacture, at our sole discretion, we will either repair or replace it free of charge. We hope you’ll be a lifelong customer and so we’ll treat you that way.
We recognise our responsibility to the environment and a key part of this is the quality of the products we create and the longevity they deliver. Increased durability means that we as a company consume only what we need and are firmly focused on minimising the impact on the environment. LAT56 has taken more care in design and manufacture which frees you to concentrate on travelling from A to B.
3.2. Once you own a LAT56 product you become an elite status customer instantly. Not only do you get to enjoy using our innovative products which are designed to be the best they possibly can, you also get to experience personal, world-class, after-sales customer service and peace of mind that for five years after you purchase a LAT56 product from an authorized LAT56 store or retailer you will be covered by our Limited Lifetime Guarantee.
For the first five years that you own your LAT56 product, LAT56 will repair or replace any items that are defective in materials or workmanship, including any structural defects (such as defective handles or zippers). However, we will not cover damage resulting from wear and tear that is not the result of defects in materials or workmanship. We also will not cover damage caused by airlines or other transit damage. Damage claims in transit cases should be filed against the carrier. Other damages not covered are damage resulting from abuse, cosmetic damage (such as scratched leather, nylon, EVA or stained fabrics) and incidental or consequential damages, such as damage to or loss of the contents of a bag, loss of use, loss of time, or similar expenses.
If we determine that a replacement product is not available, we will provide you with a product of comparable value.
The LAT56 Limited Lifetime Guarantee extends to the original owner; it makes life simple and is part of the overall LAT56 experience.
3.3. What You Need To Do:

Your only responsibility is to ship your product to us (postage paid by the customer). We will repair or replace it quickly and courier it back at no additional cost to you. In those cases where our warranty does not apply, we will promptly provide you with an estimate of any repair and return shipping costs that may be involved.
Keep your Proof of Purchase:
Please save your receipt as proof of purchase. This will be needed to demonstrate your warranty coverage. Additionally, this will serve as proof that your purchase was made at an authorised LAT56 retailer. The Limited Lifetime Guarantee only applies to products that were purchased from an authorised LAT56 store or retailer.

4. PRICE
4.1. The price that you pay for the product will be the price that is displayed on the website at the "Check Out" stage.
All prices are quoted in GBP, EUR or USD and are inclusive of value-added tax (VAT) where applicable (UK only), but exclude any delivery charges.
4.2. All purchases are usually invoiced at an amount inclusive of VAT at 20% (UK only).
LAT56 will automatically exclude any VAT charges, when permitted by law, based on the country to which the product is to be delivered.
4.3. Any discounts we offer are time-limited and are dependent on product availability. Accordingly, the price of such products may change from time to time.
4.4. We will take payment from your debit or credit card after you confirm the "Check Out" stage of the order.
If we are unable to supply the product that you have ordered, we will contact you by e-mail to offer you either a full refund or a substitute product.
If we do not receive a response from you within a reasonable time frame of our first attempt to contact you, we will refund the total amount we deducted from your debit or credit card.
4.5. We accept payment from all major credit card companies including Visa, MasterCard and American Express. We can also accept PayPal.
4.6. We will endeavour to ensure that all prices on our website are accurate. However, pricing errors may occur.
If an error is found in the price of the product you have ordered, we will contact you as soon as possible.
If a product′s correct price is lower than the price stated on our website, we will charge the lower amount to your debit or credit card and send the product to you.
If a product′s correct price is higher than our stated price, then we will give you the option of either continuing with your purchase at the correct price or cancelling the order affected by the error.
We will deem the order cancelled if we do not receive a response from you within a reasonable timeframe of our first attempt to contact you.
In such a case, we will refund the total amount we deducted from your debit or credit card.
4.7. For deliveries outside of the UK, you may be required to pay import duty, customs charges or other local taxes.
Customs policies vary widely from country to country so please contact your local customs office for further information.
Please note that the payment of any import duties, customs charges, local taxes or any administration charges paid to couriers in relation to these fees, is for your own account.
Latitude 56 Degrees Limited cannot be held responsible for the payment of any of the above-mentioned charges.
5. DELIVERY
5.1. We will attempt to deliver the Goods to the place designated by you in the accepted order, during normal business hours Monday-Saturday. We employ a third party company as our carrier to make these deliveries.
5.2. Unless otherwise expressly agreed in writing, any delivery date or time specified by us in any quotation, despatch note or otherwise, is a best estimate only and we will not be liable to you for any loss or damage sustained by you if we fail to meet that timescale because of circumstances beyond our reasonable control.
5.3. The delivery costs, as quoted, are for your account. A delivery charge will be added to your order prior to acceptance, and will be paid by you.

6. RISK AND TITLE
6.1. Ownership of the Goods and the risk of damage to the Goods will pass to you upon delivery.
7. DAMAGE OR LOSS IN TRANSIT
7.1. We shall repair or replace, free of charge, any Goods damaged or lost in transit where delivery has been made by our carrier, provided that you give us written notification of such damage or loss within 7 days of the date of receiving the Goods (so that we may comply with our carrier′s conditions of carriage).
8. YOUR RIGHT OF CANCELLATION
8.1. You have the right to cancel the Contract for the purchase of any of the Goods within 14 calendar days of delivery. Full refunds will be made minus the cost of delivery charges. If the goods have not incurred any despatch costs then a refund will be made including the cost of delivery charges. If you decide to cancel within the 14 calendar days, you then have a further 14 days to send the goods back from the point of receiving the returns documentation from LAT_56 Returns Department.
8.2. We are obliged to exchange the goods or provide you with a full refund (not including delivery charges) provided that, where delivery has taken place, you have returned the Goods to us in 100% the same condition that they were delivered.
8.3 LAT_56 will not accept order cancellations after the return period has closed.
8.4 LAT_56 will not accept any order cancellation request if the goods have been used on a trip and are no longer in 100% resalable condition, and where the reason provided for the cancellation is product performance or that the product has negatively impacted your personal belongings packed inside our luggage.
Damage or change in the condition of your personal belongings packed into our luggage does not qualify as a reason for order cancellation or refund.
We do not accept returns when goods have been used on a trip, 'in the field'. Goods must only be assessed in an environment with conditions where they can be returned after assessment in a 100% resalable condition, just as the goods arrived to you. This environment, such as your home, must be in a condition where no wear or tear, or contamination can occur to the bag. There must be no sign of usage or the Order Cancellation will not be accepted. It is your responsibility to assess the goods before it is used 'in the field' on a trip and this assessment must be made within the order cancellation period set out in 8.1.
We are not held liable for the way you pack, the method of doing so, or what you choose to pack in our luggage. This is due to the extreme variables outwith our control, such as but not limited to; humidity, temperature, variables in personal clothing fabrics packed into our luggage (such as suits), other contents you have packed (or overpacked) inside the luggage which may have a negative impact on your other belongings (e.g. suits), your own packing method, external forces on our luggage when in transit, or the duration that items are packed inside our luggage.
Using goods on a trip 'in the field', with unlimited extreme variables outwith our control, and then attempting to cancel the order does not meet the terms of your right to Order Cancellation, whether within the 14 day period as described in 8.1 or after.
8.5. If you choose to exercise your right of cancellation, please email our customer services team at [email protected] for instructions on the returns procedure.
In all cases, you should package the 100% unused goods securely in 100% of the original packaging and return them to our designated return address with the return documentation and return # which will be provided to you by customer services.
Once goods arrive at the return address provided they shall go through Quality Control assessment. Only once deemed a pass shall the refund be made. The refund may take up to 14 days upon receiving the goods.
8.6. For your own protection, we recommend that you use a recorded delivery service. You are responsible for the cost of returning the Goods to us, unless we delivered the items to you in error or the Goods have a defect.
8.7. If you do not return the Goods as required by this Contract, we may charge you a sum not exceeding the direct costs of recovering the Goods.
9. COMPETITIONS
9.1. The following competition terms and conditions apply to any such activity by Latitude 56 Degrees Ltd, including those promoted by any of its trading names, such as LAT_56 or McLaren LAT_56.
9.2. Prize draws are open globally to entrants who are eighteen (18) years old and over, excluding employees and their immediate families of Latitude 56 Degrees Ltd (the “Promoter”) and of their affiliated companies or agents, or other persons professionally connected to any draw.
9.3. By entering a competition, an entrant is indicating his/her agreement to be bound by these terms and conditions.
9.4. The duration of any competition will be as advised by the Promoter in the competition details. No bulk, consumer group or third-party entries will ever be accepted. Entries disallowed due to technical issues shall not be included in any draw.
9.5. In any competition, one entry is allowed per person and per social media account. Sharing of accounts for purposes of the competition is not allowed. If the Promoter discovers or has reasonable grounds to believe that you have exceeded the maximum number of entries you may be disqualified.
9.6. No responsibility can be accepted for entries not received for whatever reason.
9.7. The prize will be as specified by the promoter’s competition announcement.
9.8. The prize is as stated and no cash or other alternatives will be offered. The prizes are not transferable. Prizes are subject to availability and we reserve the right to substitute any prize with another of equivalent value without giving notice.
9.9. Winners will be chosen at random from all entries received and verified by Promoter and or its agents.
9.10. The winner will be notified by DM on Twitter/Facebook/Instagram or email within 28 days of the closing date advised. If the winner cannot be contacted or does not claim the prize within 14 days of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner.
9.11. The promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.
9.12. The competition and these terms and conditions will be governed by Scottish law and any disputes will be subject to the exclusive jurisdiction of the courts of Scotland.
9.13. No promotion is in any way sponsored, endorsed or administered by, or associated with, Facebook or Twitter or other social media channel.
9.14. The name and country of the winner will be made available after the conclusion of any competition. To obtain this information contact Latitude 56 Degrees Ltd at the address previously stated.
9.15. Any personal data relating to participants will be used solely for the purposes of any promotion. Data may be provided to a third-party service provider essential for the purposes of administering the prize, but will not be disclosed to a third party for any other purpose without the individual’s prior consent.
9.16. The Promoter is Latitude 56 Degrees Ltd, registered at the address previously stated.
10. LIMITATION OF LIABILITY
10.1. To the extent permitted by applicable law, in no event will we be liable for any damages arising from or relating to any product purchased from LAT56 or the use of or inability to use any such product including, but not limited to any loss of use, lost profits, loss or damage to goodwill or business nor for any consequential, indirect or incidental damages.
10.2. To the extent permitted by applicable law, our aggregate liability (whether in contract, tort or otherwise) for any loss or damage shall, in any event, be limited to a sum equal to the amount paid for the product in question.
11. GOVERNING LAW
11.1. This Contract is governed by the laws of Scotland and the Scottish courts shall have the non-exclusive jurisdiction to resolve any disputes arising out of or under it.
11.2. No waiver by us of any breach of the Contract by you, is considered as a waiver of any subsequent breach of the same or any other provision.
12. AMENDMENTS
12.1. We reserve the right to make changes to these Sale Terms at any time. You will be subject to the Sale Terms in force at the time you place your order with us.
